Our Approach to Copyright

Negativa operates as a visual reference archive and search engine for creative professionals. We respect the intellectual property rights of content creators and operate within established legal frameworks for curation and reference services.

What We Are

Negativa is a reference and discovery platform, similar in function to:

• Image search engines (Google Images, Bing Images)
• Visual bookmarking services (Pinterest, Are.na)
• Creative reference libraries
• Design research archives

What We Are Not

We are NOT a stock photography service. Images accessed through Negativa:

• Are for reference and inspiration only
• Cannot be used in final commercial deliverables
• Remain the property of their original creators
• Are not licensed for redistribution

Our Legal Basis

Our service operates under principles established by courts regarding search engines and reference services, including:

• Perfect 10 v. Google (9th Cir. 2007): Established that thumbnail images for search indexing can constitute fair use
• Kelly v. Arriba Soft (9th Cir. 2003): Confirmed transformative use of images for search and reference purposes
• Section 512 Safe Harbor: We maintain DMCA compliance and respond promptly to valid takedown requests

Digital Millennium Copyright Act Notice

Image Negativa LLC respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). We respond promptly to valid takedown requests from rights holders.

Filing a DMCA Takedown Notice

If you believe your copyrighted work has been used in a way that constitutes infringement, please provide our designated agent with the following information:

1. Identification of the copyrighted work claimed to be infringed, or a representative list if multiple works are involved
2. Identification of the allegedly infringing material and information sufficient to locate it (e.g., URL or image ID)
3. Your contact information, including name, address, telephone number, and email address
4. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
5. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf
6. Your physical or electronic signature

Designated DMCA Agent

Our Response Process

1. We will acknowledge receipt of your notice within 24 hours
2. We will review the notice for completeness
3. If valid, we will remove or disable access to the material within 72 hours
4. We will notify the user who posted the material (if applicable)
5. We maintain records of all takedown requests for legal compliance

Counter-Notification

If you believe your content was removed in error, you may file a counter-notification including:

• Identification of the removed material and its prior location
• A statement under penalty of perjury that removal was due to mistake or misidentification
• Your name, address, and phone number
• Consent to jurisdiction of federal court in your district
• Your physical or electronic signature

Repeat Infringer Policy

In accordance with the DMCA, we maintain a policy to terminate users who are determined to be repeat infringers. We reserve the right to:

• Terminate accounts of users who receive multiple valid DMCA notices
• Refuse service to individuals with a pattern of infringement
• Implement technical measures to prevent repeat infringement
